Ovako Terms of Use - Full Version

Before downloading any type of media from the Ovako Media Bank please read through the full Terms of Use. Ovako will continuously update the Media Bank.

Acceptance of the Terms of Use means that the user has read through all the Terms of Use below. The Terms of Use are binding for all users. The term user means the person, organization or company that uses media items from the Ovako Media Bank.

Users must at all times be aware that a media item may be subject to alternative and/or additional conditions that may be applied in connection with the downloading of a specific media file. In such cases, the additional conditions shall prevail over these Terms of Use.

All media items have an “expiry date” that must be followed and respected. Some media items will also be marked with a symbol indicating how the media item is allowed to be used (bith internally or externally).

All media items in the Ovako Media Bank may be used at no charge but should be used in a context that relates directly to Ovako.

As is

The Ovako Media Bank is always available on an "as is" basis. This means that the content and the Terms of Use are subject to change and the information available may change from day to day. It is therefore essential that all users read the Terms of Use each and every time an item from the Ovako Media Bank is used.

Users of media items must download the items themselves and each time they do this they accept Ovako’s Terms of Use. Media items from the Ovako Media Bank may not be transferred to any third party. If downloaded media items are used more than once, they must be downloaded at each use since new Terms of Use may be attached to them.

Disclaimer

Ovako shall not be held liable for loss of access to media items provided in the Ovako Media Bank. Ovako accepts no liability for technical faults in the Ovako Media Bank and Ovako does not provide any guarantee that the Ovako Media Bank is free from viruses or anything that may affect the equipment of external users. Ovako accepts no liability for the inability of users to use the site correctly.

Media items must not be used in any form or context that may be offensive, harmful to Ovako or others, misleading or illegal. Media items may not be used in such a way that they may offend the original author, photographer or distribution company and/or persons depicted in the media items.

Ovako shall not be held liable for inaccurate media item information supplied by a third party.

Original Author

Original Author means, for all media items in the Ovako Media Bank, the individuals who created the item. The original author (and in case of a performance, people) must be credited each and every time the item is used. If the original author cannot be determined, a clear reference must be made to Ovako.

Reproduction

The items in the Ovako Media Bank may not be duplicated. Each and every time an item from the Ovako Media Bank is used the item must be downloaded and used as is. Downloaded media items from the Ovako Media Bank must not be modified or digitally manipulated in any way other than to adjust size, crop, or make minor adjustments to color attributes in order to optimize them for print production.

Fair dealing rights

Nothing in these Terms of Use is intended to reduce, limit or restrict any usage free from copyright or rights arising from limitations or exceptions that are provided in connection with the copyright protection under copyright law or other applicable laws.

Restrictions

The Ovako Media Bank Terms of Use must be adhered to at all times and for all users of the Ovako Media Bank.

If it is necessary to make changes to a media item in the Ovako Media Bank, please consult Ovako at media.bank@ovako.com before making any such changes. Any changes must be approved in writing and may not be used for any purpose other than that specifically approved. Any changes should do no harm to Ovako or any other party, and the changes must stay within the law and maintain a professional tone.

The user

Users of a media item must download the media item themselves and each time accept Ovako’s Terms of Use. This is a condition for all users of the Ovako Media Bank. A media item from the Ovako Media Bank may not be transferred to any third party. If downloaded media items are used more than once, they must be downloaded at each use since new Terms of Use may be attached to the media items.

Any person, company or organization using a media item from the Ovako Media Bank must comply with all Terms of Use and is responsible for all usage of the media item. The user acquires a non-exclusive and non-transferable right to the media items in the Ovako Media Bank.

If a user violates the Terms of Use, Ovako retains the right to prohibit a specific user from using media items in the Ovako Media Bank and to withdraw rights to certain individual media items without any further explanation. In combination with such withdrawal, the user must unpublish and delete the media items downloaded from the Ovako Media Bank, and to the extent that it is possible, remove the media items from locations where they are used or disseminated.

The user shall be liable for any loss or damages which may arise as a result of claims brought by copyright holders or people portrayed in the media items/items due to inappropriate usage of the media items in the Ovako Media Bank.

Disputes

Disputes concerning the interpretation or application of these Terms of Use shall be adjudicated under Swedish law.

Ovako logos

Before downloading and using any Ovako logo from the Ovako Media Bank please read Ovako Graphic Identity Guidelines.

The Terms of Use and Ovako Corporate Identity are binding for all users of the Ovako Media Bank.

The naming of each Ovako logo is descriptive.

Ovako logos can be used separately or in combination with text and other media but must never be used in other combinations or in a harmful way.
